1. Agreement
By using this website or completing a booking, you agree to these Terms and Conditions, our Booking and Refund Policy, Privacy Policy and Cookie Policy.
2. Our service
We arrange and facilitate private Watamu marine excursion packages, including half day and full day boat charters, with supporting booking and payment services. Captains and guides operate under applicable Kenyan marine and park requirements.
3. Guest responsibilities
- Provide accurate booking information and a reachable phone or WhatsApp number.
- Arrive on time at the agreed meeting point with valid identification where required for park entry.
- Follow all safety instructions from the captain and guide.
- Pay KWS park entry fees at the gate unless we confirm otherwise in writing.
- Supervise children at all times on shore, during boarding and on the water.
4. Activities and wildlife
Marketing descriptions and activity checkboxes describe typical experiences. They do not guarantee specific wildlife sightings, exact itineraries or identical conditions on every date. Dolphin watching and other wildlife-dependent activities are opportunity-based and may be unavailable due to season, weather, park rules or animal movement.
5. Payments
Online payments are processed by Pesapal. Card data is handled by the payment provider. Booking amounts, residency pricing and optional pickup fees follow the estimate shown before checkout. See also our Payment Policy.
6. Cancellations and refunds
Cancellation windows, weather rescheduling and refund eligibility are set out in the Booking and Refund Policy. Those rules form part of these terms.
7. Limitation of liability
Marine excursions involve inherent risks. To the fullest extent permitted by Kenyan law, we are not liable for loss of personal property, injury arising from failure to follow instructions, wildlife not appearing, weather-related changes, or consequential losses such as missed flights or hotel nights.
Our total liability related to a booking is limited to the amount you paid to us for that boat package, except where Kenyan law requires otherwise.
8. Website use
You may not misuse the site, attempt unauthorised access, submit abusive content, or use automated tools that harm service availability. Content on this site is for booking and information purposes and may be updated without prior notice.
9. Governing law
These terms are governed by the laws of Kenya. Disputes will first be addressed through direct contact with our team. If unresolved, Kenyan courts have jurisdiction.
